Understanding Our Plans:
It is your responsibility to evaluate Cognomovement Plans and Subscriptions, including its features and what is offered, before selecting any Paid Plan. Cognomovement (Avalon BIM, LLC) will not issue refunds to customers on the basis of customers not understanding what the plan is or what is included/offered.
Client shall pay for all subscription fees, and hereby authorizes Cognomovement (Avalon BIM, LLC) (and its payment processors) to debit Client’s bank account or charge Client’s credit card, as stated on Client’s channel subscription and billing page. Client agrees that all subscriptions are recurring and will renew automatically.
Your appointments and well-being are very important to us. We understand that sometimes, unexpected delays can occur, making schedule adjustments necessary. If you need to cancel or reschedule your appointment, we respectfully request at least 24 hours' notice.
Our Updated Refund Policy for Sessions:
Completion Timeline for Booked Sessions:
30-Day Completion Requirement: All booked sessions must be completed within 30 days of the first booked appointment. This includes the initial session and any rescheduled sessions. This policy ensures that we can provide timely services to all our clients and manage our schedule effectively.
Rescheduling Within 30 Days: If you need to reschedule a session, it must be done within 30 days of the first session's booked date. This helps in maintaining a consistent and effective service delivery, ensuring that all clients have access to their sessions within a reasonable timeframe.
Cancellation and Rescheduling: Any cancellation or reschedule made less than 24 hours in advance will not be eligible for a refund.
Late Arrivals: If you are more than 30 minutes late for your service, we may not be able to accommodate you. In this case, the same cancellation fee will apply. We will do our very best to reschedule your service for another time that is convenient to you.
Case-by-Case Review: Refunds for sessions will be considered on a case-by-case basis. We understand that exceptional circumstances may occur, and we aim to approach each situation with fairness and understanding.
No Refunds After Session Completion: Once a session has been conducted, we will not offer refunds. We encourage clients to communicate any concerns or dissatisfaction immediately so we can strive to address and resolve them promptly.
Firm 30-Day No Refund Policy: We maintain a firm policy of no refunds for any sessions after 30 days from the session date. This policy helps us manage our scheduling and services effectively, ensuring the best possible experience for all our clients.
Emergency Considerations: In the event of a true, unavoidable emergency, all or part of your cancellation fee may be applied to future services. We ask that you provide as much notice as possible so we can adjust our scheduling accordingly.
Currently, the Cogno balls come free with the purchase of the Cognomovement Essentials Course (Formerly known as the Basic Training Video Course) and the Learning Portal Plus. They are not available for individual purchase at this time. Shipping for the Cogno balls is free in the United States and will be shipped within 7 - 10 days of your order. You will typically receive the Cogno balls within 7 - 10 days.

Cognomovement (Avalon BIM LLC) Terms and Conditions for Events
Please read these Terms and Conditions carefully before enrolling in any Cognomovement events. These Terms and Conditions ("Agreement") are between the participant ("Customer") and Cognomovement™, Avalon Bim LLC ("Organizer") regarding enrollment and attendance at any live or online Cognomovement event. By enrolling in an event, Customer agrees to be bound by these Terms and Conditions.
1.1. Customer may transfer their event enrollment from the originally purchased event date to the next desired and available date one time only, without any additional charge.
1.2. Customer may transfer their event enrollment to another individual or transfer their event enrollment to a Cognomovement™ product or to a Cognomovement VIP Session without any additional charge.
1.3. After an initial transfer, Customer may transfer their event enrollment subject to a $75 transfer fee for each subsequent transfer.
1.4. To transfer, Customer must notify Cognomovement™ by email at email@example.com. Enrollment transfers are subject to availability and are processed on a first-come, first-serve basis.
2.1. Customer may cancel this transaction without penalty by emailing Cognomovement™ at firstname.lastname@example.org, provided the cancellation email is sent prior to midnight of the third business day after the online purchase and prior to the event commencement.
2.2. Refunds for cancellations will be issued within 4-6 weeks based on the original method of payment.
2.3. Cancellations after the third business day and more than 30 days before the event will incur a $195 Damages Fee.
2.4. No refunds will be provided if Customer cancels within 30 days of the event start date.
3.1. No refund will be provided if Customer fails to attend the confirmed event.
3.2. Customer must obtain advance written consent from Cognomovement™, Avalon Bimm LLC to be eligible for a refund due to non-attendance.
4. General Provisions:
4.1. Customer acknowledges that they are not relying on any warranties, promises, guarantees, or representations unless they are in writing and signed by an authorized representative.
4.2. These Terms and Conditions supersede all previous materials, representations, or agreements, whether oral or written.
4.3. Modifications to these Terms must be in writing and signed by both parties.
4.4. This Agreement is governed by the laws of the State of California.
4.5. Event details, including dates, times, locations, and structure, are subject to change.
4.6. Cognomovement™ reserves the right to terminate this enrollment for any reason, with tuition credits and refunds considered on a case-by-case basis.
4.7. This Agreement may not be assigned without written approval from Cognomovement™.
Consent for Photography, Audio, and Video Recording:
By entering the event premises, Customer consents to interviews, photography, audio recording, and video recording. Customer agrees that these materials may be used for various purposes such as news, webcasts, promotional purposes, telecasts, advertising, and social media by Cognomovement™ and its affiliates. Customer releases Cognomovement™, its officers, and all persons involved from any liability connected with such use.
By enrolling in any Cognomovement event, Customer acknowledges that they have read, understood, and agreed to these Terms and Conditions.
VIP Session Terms & Conditions
These terms and conditions ("Terms") govern your participation in and use of the Cognomovement VIP sessions. By purchasing or participating in a VIP session, you agree to these Terms.
2. Booking and Payment
- All bookings for VIP sessions must be made in advance.
- Payment for sessions must be made upfront and is non-refundable, except as set out in these Terms.
- We accept payments through invoice options sent.
3. Session Rescheduling and Cancellation
- If you need to reschedule a Zoom session, you must give us at least 48 hours notice. Failure to do so may result in a forfeit of that session. If you need to reschedule an in-person session, travel fees will apply.
- In the unlikely event that we need to cancel a session, you will be offered a rescheduled date or a refund for that specific session.
4. Travel and Accommodations (For In-Person Sessions)
- If the client is traveling to Liz or Bill, the client is responsible for their own travel and accommodation arrangements and expenses unless otherwise agreed upon in writing.
- Travel fees for Bill's or Liz's in-person sessions are separate and not included in the package price.
5. Conduct During Sessions
- Clients are expected to conduct themselves professionally and respectfully at all times.
- We reserve the right to terminate a session if a client displays inappropriate or disruptive behavior.
- All information shared during the sessions will be kept confidential unless required by law.
- We respect your privacy and will not share your personal information without your explicit consent.
7. Intellectual Property
- All materials, techniques, and content provided during the sessions are the property of Cognomovement and may not be replicated, shared, or distributed without written consent.
8. Limitation of Liability
- Our services are provided "as is" without any guarantees or warranties, either expressed or implied.
- We do not guarantee any specific outcomes or results from the sessions.
- Neither Cognomovement nor any of its representatives shall be held liable for any direct, indirect, incidental, or consequential damages resulting from the use of its services.
- These Terms represent the entire agreement between the parties and supersede any previous agreement, whether written or oral.
- If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
- These Terms are governed by the laws of the states of California and Oregon, and any disputes arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of California or Oregon.
